Preamble

The contracting parties, Bambual Editora Portugal, Lda., as the supplier of goods and service provider, and the Buyer, the individual who purchases a good or service, agree to these terms and conditions.

Point 1 – OBJECT

These general terms of sale aim to provide and define all necessary information to the Buyer, by Bambual Editora Portugal, Lda., hereinafter referred to as “Bambual”, regarding the methods of ordering, selling, paying, and delivering purchases made on Bambual’s website, hereinafter referred to as the “Site”, at the address www.bambualportugal.pt.

These terms regulate the conditions and necessary steps to place an order, with Bambual guaranteeing the shipment and/or provision of services related to the order made by the Buyer on the Site, after payment for the purchased goods and/or services has been confirmed.

These general conditions will not apply if it is determined by the quantity ordered that the Buyer is not a final consumer, according to the definitions outlined in paragraph c) of Article 3 of Decree-Law No. 24/2014 of February 14.

Point 2 – PRICES

  1. Prices are in Euros, including applicable taxes and fees, considering the VAT rate in effect at the time of payment of the order.
  2. If there is a change in the price lists of products available for sale on the Site, an update of the advertised prices will be made. If this occurs with a product in the “shopping cart” but the payment has not been completed, Bambual will not honor the previous price of the chosen Good or Service.
  3. The prices presented at the checkout process on the Site always reflect the most up-to-date prices, but they should only be considered valid while they are visible on the respective Site. Bambual guarantees the order and its value only if the payment conditions outlined in subparagraph n) of Point 4 of these General Terms are met.

Point 3 – DISCOUNTS

  1. All promotions have a set duration period, which will be specified next to each product or in other areas on the Site.
  2. Promotional discounts are valid during the announced period, provided that the order is completed by the Buyer and paid according to the methods outlined in Point 4 – “Order” of these General Terms of Sale.
  3. In the case of bank transfers, the payment receipt must be sent within the time frame stipulated for the promotional discount to the email editora@bambualportugal.pt.
  4. Adding a product to the “shopping cart” does not guarantee the price or discount of that product.

Point 4 – ORDER

The Buyer can place their order through the Site at www.bambualportugal.pt, choosing and deciding on the goods and/or services to purchase:

a) Select from the product and/or service catalog available on the Site, where the characteristics, conditions, and price including VAT will be listed;

b) Select the product and/or service to be purchased and/or subscribed to;

c) Enter their email for contact;

c) Confirm the product and/or service choice with a validation click, acknowledge the “Terms and Conditions” and if agreed, confirm by clicking. If not agreed, the purchase cannot be made. Before proceeding with payment, the Buyer may also agree to receive updates, promotions, and exclusive products and services from Bambual by clicking “Keep me updated on new releases and exclusive offers.”;

d) Complete and provide the following information and choose the available options throughout the order confirmation process: i) full name; ii) landline and/or mobile contact number; iii) delivery address. If a different address for invoicing is required, immediate notification must be sent via the Site or email to Bambual; iv) email – confirm or modify;

e) Click the “continue” button;

f) Choose the available shipping method;

g) Click the “continue” button;

h) Choose the payment method from the options available on the Site;

i) Tax identification number must be added in the “comments/notes” for invoice issuance, as well as the name if it differs from the one initially indicated;

j) Confirm the payment for the product and/or service by bank transfer or PayPal.

m) Through PayPal, whose privacy policy can be viewed here – https://www.paypal.com/pt/webapps/mpp/ua/privacy-full, proceed with payment on this operator’s site, as automatically redirected by Bambual’s Site. The debit will be made from the Buyer’s account or card, as chosen on PayPal’s site. If an ordered product is out of stock on Bambual’s site, the corresponding amount will be refunded via the same method, either through PayPal or alternatively by bank transfer, thus completing the order process;

n) The order will only be considered if the Buyer has made the effective payment of the requested amount on the Site, either via PayPal or by bank transfer with receipt sent to Bambual by email or paid in cash at our premises. If payment is not received within the promotional campaign period, the order cannot be validated nor considered under the campaign’s terms.

o) The Buyer will await an email from Bambual indicating the availability of the product and/or service and, if applicable, confirming the order, at which point shipment will commence.

p) The shipment of the order to the Buyer presupposes acceptance of the prices and the products and/or services available for sale, as well as these general terms of sale, which will be the only applicable terms to the contract, thus concluding it;

q) Bambual will honor orders received through its Site, subject to available stock of the Good, or in the case of a service, subject to the defined capacity limits;

r) The information on the invoice is the sole responsibility of the Buyer, and once issued, no subsequent alterations will be made;

s) Order requests are valid for 15 (fifteen) days, except in cases where the order was placed under a promotional campaign for which a different deadline was set. In such cases, prices, discounts, promotions, and offers will only be guaranteed within the period mentioned on Bambual’s website.

Point 5 – SHIPPING COSTS

a) Shipping costs for Goods vary based on the weight of the order, the logistics operator, the delivery location, and the shipping method chosen by the Buyer.

b) To determine the shipping costs of an order, the Buyer should add the products they wish to purchase to the “shopping cart” on Bambual’s website. During checkout, the shipping cost will be displayed.

c) Bambual will not deliver to P.O. Boxes.

d) Bambual will make every effort to meet the estimated delivery times, but if there are difficulties in meeting delivery times, such as due to stock shortages, Bambual will notify the Buyer by email, offering the option to cancel the contract, cancel the order with a refund, partial shipping of the order if applicable, or wait for the chosen Good.

e) After confirming receipt of payment, within a maximum of forty-eight business hours, an email will be sent confirming the validation of the order. The email will be sent to the Buyer’s electronic address as indicated during the purchase process on Bambual’s website.

f) Bambual will do everything possible to ensure maximum confidentiality and security of the data transmitted over the internet and through the service providers it contracts in all operations related to the contracting of Goods or Services and the shipment of the former.

Point 6 – RIGHT OF WITHDRAWAL AND WARRANTIES

a) Any order placed on the Site may be freely withdrawn under Article 10 of Decree-Law No. 24/2014 of February 14, provided that the Buyer bears the return shipping and packaging costs. The Buyer must return their order within 14 days from the date of receipt, after contacting our order service via email at editora@bambualportugal.pt.

b) The return process is simple but varies depending on the origin of the order, so the Buyer must contact Bambual in advance via the contact email mentioned above.

c) Bambual does not accept returns sent with unpaid postage or cash on delivery, and commits to refunding the Buyer within 14 days from the date of receipt of the withdrawal communication under Article 12 of Decree-Law No. 24/2014 of February 14, or the next business day after receiving the return or proof of return of the order, whichever occurs later.

d) Refunds will be made using the same payment method the Buyer used in the original transaction or by bank transfer if the original payment method does not allow it.

e) Returned products must be in a saleable condition, i.e., in the same condition they were received by the Buyer, without any anomalies.

f) If the value of the exchanged products in an order exceeds the initial value, the Buyer must cover the difference, using one of the payment methods available in Point 4 of these General Terms of Sale.

g) If the value of the exchanged products in an order is less than the initial value, or in case of return, Bambual will refund the excess amount via the same method used for the order or, if that is not possible, via bank transfer to the Buyer’s account;

h) Free items, given as part of promotions or offers, will not be refunded.

Point 7 – COMPLAINTS

  1. The User may submit their complaints to Bambual Editora Portugal, Lda. via the email editora@bambualportugal.pt.

Point 8 – LIABILITY

Bambual is not responsible for any inconvenience or damages caused to the Consumer through the use of the Internet, such as service interruptions, external intrusions, anomalies caused by computer viruses, or any other force majeure situations.

Point 9 – PERSONAL DATA PROCESSING

  1. Privacy and Cookie Policy

The processing of your data is done in compliance with the legislation regarding the protection of personal data. For more information, please consult the Privacy Policy – Privacy & Terms – Amen.pt on the site https://www.amen.pt/company/legal/cookie/ of our intermediary IT service provider on this platform, as well as their GDPR Compliance Statement at https://www.amen.pt/company/legal/declaracao-de-conformidade-rgpd/.

  1. Secure Purchases

Bambual is confident that purchases managed directly through the PayPal service associated with your purchase are secure, as described in the “Buyer Protection and Fraud Protection” policy available on the site – https://www.paypal.com/pt/webapps/mpp/paypal-safety-and-security. Purchases made via bank transfer occur between banks, so Bambual will not have access to the Consumer’s information and will be subject to the same interbank rules as other customers.

Point 10 – APPLICABLE LAW AND COMPETENT COURT

  1. The law applicable to any contractual relationship established through Bambual’s website is Portuguese law.
  2. To resolve any conflict arising from any contract made under these general terms of sale, Portuguese law will apply, and the competent courts for dispute resolution will be the courts of Portugal, or alternatively, the Consumer Alternative Dispute Resolution entities, as agreed upon by the parties.
