Please read this page to familiarise yourself with the Terms and Conditions (hereinafter also referred to as T&C) for using the online shop of Bambual Editora Portugal, Lda (hereinafter referred to as Bambual Portugal), with tax identification number 516148290, registered office at Rua Cândido dos Reis, 113, 2630-233 Arruda dos Vinhos, in Portugal and in the European Community.
Use of the Shop implies acceptance of these T&Cs.
Bambual Editora Portugal, Lda. may amend these T&C at any time.
I – PREAMBLE
1. These T&C are agreed between Bambual Portugal and natural persons (hereinafter referred to as Customers) who wish to make purchases through the website whose address is bambualportugal.pt, hereinafter referred to as the Store.
2. The purpose of these general T&C is to define the general terms and conditions of sale established between Bambual Portugal and the Customer, to make available and define all the information necessary for the Customer to make the Purchase and to be duly informed of the availability of the products on sale by Bambual Portugal, as well as the acts of the Customer necessary to order, pay for the Purchases made in the Store, and their delivery by Bambual Portugal to the address indicated by the Customer.
3. These conditions regulate all the steps necessary to make the Purchase and guarantee the follow-up of this transaction between the contracting parties. The order, in the process of which the Customer expresses full and complete acceptance of the General Conditions of Online Sale and the prices and products contemplated in the respective transaction.
4. The parties agree that the purchase made through the Store will be governed by the T&Cs in force at the time of purchase and by Portuguese law.
II – SCOPE
1. These conditions apply to all products made available for sale in the Bambual Portugal Online Shop.
2. The availability of items is valid within the limits of available stocks.
III – HOW TO ORDER
1. The Customer may place orders in the Store, according to the catalogue available on the respective website, by adding the desired items to the shopping basket.
2. To make a purchase, the Customer may choose one of two methods:
2.2 Purchase without registering in the Shop, following the instructions that appear until completing the purchase process and specified in detail in the T&Cs;
2.3 Purchase with registration in the Shop, following the information indicated for this purpose, entering the email address and password to be created at the time of registration and, after this step, entering the login name and password to register. Bambual Portugal’s website, known as the Store, will shop the Customer’s information for future purchases, namely: name, full billing and shipping address, telephone number, email address, tax identification number, as well as the history of purchases made.
3. The Customer may choose and place in the shopping basket the products they wish to purchase and may also remove those they do not wish to keep.
4. Before finalising the respective Purchase, the Customer may have the possibility of using a certain Coupon of which they have been previously aware, by placing the ‘coupon code’ in the appropriate place indicated in the Store.
5. If the Customer wishes to use a Coupon during the Purchase, must use the specific set of characters or word previously indicated by Bambual Portugal, hereinafter referred to as the ‘Coupon Code’. To this end, Bambual Portugal will use one or more means to publicise it, namely its website, and/or email addressed to specific Customers on its mailing list, and/or social networks and/or communication by an entity duly authorised by Bambual Portugal, and the Coupons will be governed by the following rules:
(i). Scope: The existence of a Coupon previously defined by Bambual Portugal applies to limited and specific communication and/or marketing campaigns and/or arising from the establishment of partnerships with certain entities, with the characteristics, conditions, limits and specifications being previously defined, since a) it may be limited in time, i.e. in the duration of the respective Coupon; b) may be limited to the Purchase of certain products or services in the Store, as well as the respective quantity to be Purchased; c) to conditions related to the means of payment used in the Purchase; d) there may be limits on the number of transactions to be made per Customer and while the Coupon is valid, as well as on the quantity and products covered by the Coupon, regardless of whether or not the Customer is registered in the Store, as indicated above in point 2 of the T&C; e) there may be limited sales conditions: i) to a certain minimum monetary value of the Order or specifically related to a certain product, which may be a reduction in the final value of the Purchase, or ii) to another condition previously defined by Bambual Portugal, which may be a discount percentage on certain product(s) and consequently a reduction in the total value of the Purchase; f) there may be reductions in the cost of postage or even its total elimination, which may or may not be related to Bambual Portugal’s choice of method for sending Purchases to the Customer, either by CTT – Correios de Portugal or by a specific carrier, or by another method to be indicated by Bambual Portugal and in the way that is most convenient for it.
(ii). In order for the Coupon to be used by the Customer and applied in a specific place indicated in the Store, it must be valid and in accordance with the conditions and specifications indicated in the previous paragraph.
(iii). If the Customer does not make the respective payment in time, finalising the purchase within the period previously established in the Coupon, will not be entitled to its special conditions – limited in time, conditions and manner.
(iv). The Customer who has the relevant Coupon, before and during the Purchase, may ask to be informed of the validity, limits, conditions and specifications of the relevant Coupon, using the following email address: editora@bambualportugal.pt .
(v). If the Customer does not use the Coupon due to ignorance of its existence, or intends to use it outside its period of validity at the time of the Purchase, or has made the Purchase within its period of validity but has not yet paid for the respective Order in time, will not be entitled to its conditions and will not be able to claim this presumed right.
6. During the initial phase of the Order, the Customer can click on ‘Calculate shipping costs’ to simulate the cost of postage. If wish to change the place of delivery during the Order phase, can click on the ‘Update’ button again or continue with the Purchase using the ‘Finalise Purchase’ button.
7. Before clicking on the ‘Checkout’ button, you may also have the option of a) entering the Coupon Code b) registering in the Shop, in accordance with point 2.3 under ‘How to Order’.
8. Provide the Store with the information requested after choosing ‘Checkout’, namely the Customer’s identification details – name, full billing and shipping addresses – address, postcode and town, as well as the Country/Region and District – tax number (optional), telephone number (optional).
9. When finalising the Purchase, it is also possible to add a note to the order – special information that the Customer considers relevant. Bambual Portugal, when sending the respective Order, will not be held responsible for the fulfilment of special requests relating to delivery, since it is up to the distribution company – CTT Correios de Portugal or the carrier, whether make use of this information.
10. Confirmation of the order by the Customer, making payment using the means available on the site, implies acceptance of the Store T&C in a specific place, by clicking on them, fully accepting the prices, the description of the products ordered and these Terms and Conditions of Sale.
11. Bambual Portugal will honour the order received from the Customer up to the limit of available stocks. If the product is not available, Bambual Portugal undertakes to inform the Customer as soon as possible.
12. The Customer’s identification details on the invoice are the sole responsibility of the Customer. Once the invoice has been issued, it cannot be altered.
13. The order is valid for five working days, after which it will not be possible to guarantee prices, discounts, promotions and offers beyond this period. If the order is registered under a different validity, (i.e. pre-sale product), all the conditions established at the time of the Order will be maintained, even if delivery of the product is delayed for reasons internal or external to Bambual Portugal.
14. If payment for the Order is not received by Bambual Portugal within the period stipulated in the previous point, the Order will be cancelled. Any amount received after this date will be returned to the Customer by bank transfer, to an account to be indicated by the Customer.
IV- PAYMENT
1. The Customer may pay by any of the following payment methods:
a) Bank transfer to the account indicated in the shopping basket.
b) Through the IfThenPay entity [https://ifthenpay.com/], which uses the following payment methods, some only for Portugal (namely debit cards, MbWay and Multibanco), but also credit cards for payments outside Portugal.
V- POSTAGE, DISPATCH AND DELIVERY
1. If the order is placed by 1pm on a working day, it will be dispatched within three working days.
2. Once the Order has been dispatched, it will be delivered to the address indicated by the Customer, put in the appropriate field when placing the Order, within the following timeframes:
a) Mainland Portugal and Spain (Peninsula): up to three working days; deliveries are made by CTT by registered mail or by carrier, at Bambual Portugal’s convenience. In either case, the Customer will be able to follow the delivery (tracking) using the respective registration number requested from our services.
b) Azores and Madeira: delivery in 2 to 14 working days (depending on the island and the ship’s schedule); shipments are made by CTT by registered mail or by carrier, at Bambual Portugal’s convenience. In either case, the Customer will be able to follow the delivery (tracking) using the respective registration number requested from our services.
c) European Community: between 8 and 20 working days; orders outside Portugal will always be sent by registered mail or carrier, and the Customer can track the delivery (tracking) using the respective registration number requested from our services.
d) We’re sorry, but we don’t ship outside the European Community.
3. The cost of postage depends on the destination given in the delivery address and the total value of the order. During the order finalisation process, the Customer can calculate the shipping costs.
Shipping costs:
(the figures below include VAT)
a) Mainland Portugal:
Order value (before the application of any coupon or discount) of less than 20€: 4.50€.
Purchases over €20: no postage cost.
b) Madeira and Azores:
Under €20: €5.50
Value over 20€: no postage.
c) Spain (Peninsula): €6.50
d) Spain (Islands): 10€
e) Community Europe: 10€
VI- PRICES
1. Prices are expressed in Euros, including taxes and duties, considering the VAT in mainland Portugal at the time the purchase is finalised.
2. If there is an error in the price of any product, the Customer’s order will be cancelled, and the Customer will be informed immediately.
VII- CANCELLATION, RESOLUTION AND RETURN
1. The process of cancelling an order is carried out 5 working days after the purchase, if the Customer has not made payment.
2. It is not possible to cancel an order paid for by credit card, as the order will be dispatched immediately.
3. To return an order, the Customer has 14 days after receiving it to express their intention by email: editora@bambualportugal.pt .
4. Return postage and risks are borne by the Customer, unless there is a manufacturing/printing defect or error in the fulfilment of the order.
5. Reimbursement to the Customer is usually made by bank transfer, not by the original method of payment, within 48 hours of correct receipt and evaluation of the returned products.
6. Returned products must be in saleable condition, i.e. in the same condition as when they arrived in the Customer’s hands, without any anomalies, damage or signs of use.
7. If the products are returned with anomalies, damage or signs of use, Bambual Portugal will not refund them.
VIII- COMPLAINTS
1. If the Customer is dissatisfied with a product or with the purchase process and does not accept the solution we have provided, they may resort to the Lisbon Consumer Conflict Arbitration Centre, at www.centroarbitragemlisboa.pt , or to the Electronic Complaints Book, at www.livroreclamacoes.pt .

© BambualPortugal . All rights reserved. The total or partial reproduction of the contents of the sites owned by Bambual Portugal and of the content it owns placed on other sites (hereinafter sites and content) is prohibited.
All content, graphic design, text, images and sounds included in the sites and content are licensed by Bambual Portugal or its exclusive property and are protected by Intellectual Property Law and/or Industrial Property Law. Usurpation, counterfeiting, exploitation of usurped or counterfeited content, illegitimate identification and unfair competition are criminal offences.
X- LICENCE AND USE OF CONTENT
1. The reproduction, transformation, use and distribution of any element on the sites and content without the prior written authorisation of Bambual Portugal is illegal.
2. The Customer is granted a licence to view the websites and content on an electronic screen, as well as the following partial licences if they do not provide any financial income or equivalent benefit to the Customer:
a) on the Bambual Portugal website (https://bambualportugal.pt), including pages and profiles on Facebook, Instagram, Linkedin and other social networks) which is intended for:
i) free reproduction of content intended to accompany critical reviews of published titles;
ii) use of the mechanisms made available or to be made available by Bambual Portugal for self-dissemination of the ‘share with a friend/share’ type, except for spam purposes or to annoy other people.
iii) use of the mechanisms made available or to be made available by Bambual Portugal for self-posting on other sites of the ‘embed’ type, except on pornographic, obscene or sites that offend prevailing morals.
iv) free reproduction of Press Centre content for information purposes.
b) Content owned by Bambual Portugal and placed by it on other sites:
– reproduction of the contents under the terms defined by each site.
XI- RESTRICTIONS
When using the sites and content, the Customer undertakes not to:
1. use any mechanism, computer programme or technology to interfere or attempt to interfere with the normal operation of the sites and content.
2. send or transmit illegal, fraudulent, defamatory or obscene information through or to the sites and content.
3. send or transmit to or through the sites and content information that contains viruses or bugs.
4. publish, represent, distribute, create derivative works from, reproduce or use the sites and content, excluding the limited use provided for in the previous article.
5. send or transmit information that violates the intellectual or industrial property rights of third parties.
6. carry out any activity that overloads the infrastructure of the websites.
7. display any part of the sites and content using framing, embedding, or other technology without the licence granted in the previous article or without the express written authorisation of Bambual Portugal.
8. use any technology that allows automatic attempts to access sections of the sites and content protected by a password or digital certificate.
XII- ACCESS TO THE SITE BY THE CUSTOMER
1. If the Customer is authorised to access sections of the site protected by a password or a digital certificate recognised by the site, the Customer undertakes to keep the password or digital certificate confidential and to notify Bambual Portugal within 24 hours if the confidentiality of their password or digital certificate is compromised.
2. The Client recognises that Bambual Portugal does not sponsor the site to which it links and that Bambual Portugal is not responsible for the content of that site.
3. The Customer recognises that the
(i) The Internet is a worldwide computer network and that any information sent or transmitted by it will necessarily be forwarded by third party computers,
(ii) Bambual Portugal is not responsible for failures in communications security and assumes no responsibility for the improper use of its information by third parties.
XIII- INFORMATION SENT OR TRANSMITTED BY THE CUSTOMER
By sending or transmitting information to the site, including, but not limited to, opinions, comments and ratings, the Customer grants Bambual Portugal a non-exclusive, worldwide and free licence to link, use, reproduce, exploit and prepare derivative works of the information submitted. The information sent or transmitted by the Client will not be considered confidential information. The Client will be responsible for the content of the information sent or transmitted to the site. The Customer also grants Bambual Portugal the right to delete or remove any information sent or transmitted by the Customer that is not in accordance with the aims and purposes of the site, namely on sites with promotional or advertising purposes. Any information containing personal data will be processed in accordance with the law.
XIV- EXCLUSION OF LIABILITY
The Customer recognises that access to and use of the site and contents may be interrupted and that the information on the site and contents may contain errors, technical faults, problems or other limitations and that access may be impossible at certain times. Bambual Portugal is not responsible for any damage caused by the use of the site and contents.
Information on future title releases is provided on a provisional basis and may change up until the release date. Bambual Portugal is not responsible for any damages caused by the alteration of this information.
XV- LAW AND JURISDICTION
Portuguese law applies to these Terms & Conditions. For any dispute arising between Bambual Portugal and the Customer, the courts of the district of Lisbon in Portugal shall have exclusive jurisdiction.
